Facts/Liability:

This is a medical negligence claim in which the plaintiff, a seventy-two year old mother and grandmother, alleged that the defendant failed to timely diagnose and treat her toe infections which progressed to osteomyelitis and then spread to her spine and sternoclavicular joint. She underwent multi-stage spine surgery with placement of hardware, required several extended hospitalizations, and endured months of intravenous outpatient antibiotic administration.

Suit was brought against the defendant and the defendant’s employer.

Injuries:

The plaintiff developed a metastatic infection in her spine which caused pain that was described by her doctors as intractable, unremitting, and excruciating. She underwent a two stage surgery that lasted approximately eighteen hours during which extensive hardware was bolted into her bones. She then endured months of IV antibiotic therapy, narcotic pain medication, and back brace discomfort as well. She essentially went from one hospital to another for five months.
