VERDICT/SETTLEMENT

Facts/Liability:

This is a medical negligence claim arising out of the medical care provided to a 48-year old husband and father, when he presented to the defendant medical center for treatment of bilateral subdural hematomas that he sustained in a fall at his home. The procedure was performed by two resident physicians, who horribly miscalculated the angle of the entry of the catheter during the procedure. Their actions resulted in an unloading of liquid into our client’s brain, as opposed to the placement of the catheter into the area of the hematoma, between the skull and the brain, causing a massive stroke and permanent brain damage.

Suit was filed against the defendant medical center, as well as a defendant clinic practice for their vicarious liability of their agents/employees associated with the plaintiff's care and treatment.

Injuries:

The plaintiff has suffered an irreparable brain injury causing, among many injuries, partial paralysis on his dominant side, causing him extreme difficulty in walking, very limited use of his arm and hand, as well as difficulty with his speech. He has incurred unnecessary medical expenses and procedures, both now and in the future.
