This is a medical negligence claim arising out of the medical care and treatment the defendants provided to the decedent plaintiff, a 45-year old husband and father, which allowed the plaintiff's rectal cancer to go undiagnosed and untreated for four years, causing his painful, unnecessary, premature death. The plaintiff presented to his primary care physician with symptoms of rectal bleeding two to three times a week. He was diagnosed with internal hemorrhoids and no further testing, exam or referral was ordered. Because the defendants’ failed to investigate the decedent plaintiff's complaints of rectal bleeding, and diagnose its course the plaintiff's rectal cancer was allowed to grow and spread until he was diagnosed four years later, resulting in surgery for removal of a large, rectal mass, a permanent colostomy, and his premature death.
The estate sued the defendant hospital for their vicarious liability of their agents/employees associated with the plaintiff's care and treatment.
The decedent plaintiff's rectal cancer went undiagnosed for four years, resulting in surgery for removal of a large, rectal mass, ileal conduit, as well as a pelvic abscess, DVT and permanent colostomy. He incurred substantial medical, hospital, and therapy expenses. He suffered emotional and physical pain, and ultimately a premature death at the age of 50. His estate incurred medical and funeral expenses and lost earnings.
