Facts/Liability:  

 

This is a medical negligence claim brought by a 55 year old retired Marine with a considerable family history of vascular disease, the extent of which was known to his medical providers. The defendant doctors in this case completely failed to diagnose and treat the plaintiff’s symptomatic carotid dissection between February and April 2007, which resulted in a life-altering stroke on the plaintiff’s 55th birthday, in May of 2007. Due to the defendant’s failure to diagnose and treat his classically symptomatic condition, the plaintiff was catastrophically injured and left permanently disabled.

The plaintiff suffers from right hemiplegia, with essentially no functional use of his right upper extremity, which has resulted in contracture of his right hand, and ambulation only with the assistance of ankle-foot orthoses and a cane. Additionally, he suffers from very severe expressive aphasia; he cannot read in any meaningful way or do math; he has chronic daily fatigue and he suffers from a permanent seizure disorder. He has not returned to his work as a shipping and receiving clerk since his stroke and he is not expected to ever be able to return.
