Abramson, Brown & Dugan Files Civil Lawsuit Against Elliot Hospital Following Allegations of Pediatric Sexual Assault

Manchester, NH — March 27, 2026 — Abramson, Brown & Dugan today announced that it has filed a civil lawsuit against Elliot Hospital on behalf of a young child patient and her parents, alleging severe misconduct and negligence arising from the sexual assault of the child by a hospital employee.

The plaintiffs filed the lawsuit on behalf of their daughter, identified as W.O., a four-year-old child with autism and limited verbal communication. The complaint alleges that, while admitted to Elliot Hospital between September and October 2025, W.O. was subjected to repeated sexual abuse by a nursing assistant employed by the hospital.

According to the lawsuit, the employee was permitted to provide unsupervised care to pediatric patients, including W.O., which allegedly enabled the abuse to occur. The complaint further alleges that the employee engaged in inappropriate sexual contact and created photographic and video recordings of the assaults.

The individual accused in the complaint is currently facing multiple criminal cases in New Hampshire, including charges related to aggravated felonious sexual assault and the manufacturing and possession of child sexual abuse images.

“Children—especially those with special needs—deserve the highest level of protection,” said Nick Abramson, a former federal prosecutor who handled child sexual abuse prosecutions and one of the attorneys representing the plaintiffs at Abramson, Brown & Dugan. “This case represents a devastating breach of trust. Hospitals have a fundamental duty to safeguard their most vulnerable patients, and we intend to hold accountable anyone whose actions or failures allowed this abuse to occur.”

The lawsuit alleges that Elliot Hospital failed in its duty to ensure patient safety by allowing an employee to have unsupervised access to vulnerable child patients despite foreseeable risks.
