VERDICT/SETTLEMENT

Facts/Liability:          

This is a medical negligence claim arising out of the medical care and treatment the defendants provided to a healthy, active thirty-six year old man, who underwent surgical repair of his Achilles tendon. Approximately one month post-op, the decedent plaintiff presented to the emergency department of the defendant hospital with flank/thoracic pain and shortness of breath. The decedent was evaluated and treated by the defendant physician’s assistant in the emergency department, who was under the supervision of the defendant physician. The decedent plaintiff was diagnosed with pneumonia and discharged home with a prescription for Zithromax. He died seven days later due to pulmonary emboli that was emanating from a DVT in his right lower extremity.

Suit was brought against a physician’s assistant, an emergency medicine doctor, as well as the defendant hospital for their vicarious liability of their agents/employees associated with the decedent plaintiff’s care and treatment.

Injuries:

The decedent plaintiff’s phlebothrombosis of the right lower extremity went unrecognized and untreated, emanating into pulmonary thromboembolism and ultimately causing his premature death. The decedent suffered a loss of enjoyment of life and his estate has incurred medical and funeral expenses, loss of earnings and earning capacity, and other economic losses.

Verdict/Settlement:

Settled after suit but prior to trial for a confidential amount.
